Kapag ang murang subcontract quotation ay may nakatagong exclusions, kulang na resources at hindi realistic na programa, ang inaakalang savings ay maaaring mauwi sa delay, defects, claims at pagkawala ng project margin.
Ang Problema at Diretsong Sagot
May subcontractor na nagsumite ng pinakamababang quotation para sa isang critical work package. Ang nakasulat na quotation ay visible portion lamang ng package cost. Hindi nito awtomatikong ipinapakita ang retained risks ng main contractor, unresolved interfaces at magiging gastos kapag hindi nag-perform ang subcontractor.
Hindi ito contractual valuation formula. Isa itong management framework para makita ng project team ang probable cost na hindi lumilitaw sa tender total.

Illustrative Scenario: Murang Award, Mahal na Problema
Ang sumusunod ay fictional scenario para sa professional education. Hindi ito actual ODBEST client, identifiable project, legal precedent o ipinapakitang commercial result.
Nagpa-tender ang isang main contractor ng specialist mechanical at electrical package para sa isang infrastructure facility. Tatlong subcontractors ang nagsumite ng bid.
Malaki ang apparent saving sa lowest bid, pero excluded dito ang ilang builders’ work interfaces, temporary power, bahagi ng testing at ilang handover documents. Nakabase rin ang programme nito sa agarang access sa lahat ng work areas at tuloy-tuloy na paglabas ng design information.
Qualified ang proposed project manager, pero walang confirmation na available siya para sa project. Hindi rin kumpleto ang long-lead procurement plan.
Mas mataas ang quotation ng isa pang bidder dahil isinama nito ang mas kumpletong scope, dedicated supervision at procurement schedule. Sa simpleng bid tabulation, parehong minarkahang “technically compliant” ang dalawang bidders.
Naka-attach ang qualifications ng lowest bidder, pero hindi ito na-convert sa cost adjustments at hindi malinaw kung sino ang sasalo sa excluded obligations. Dahil kailangang maprotektahan ang procurement budget, ibinigay sa lowest bidder ang package.
Pagkatapos ng mobilization:
- Naiwan sa ibang project ang ilan sa named personnel;
- Na-delay ang long-lead procurement;
- Humingi ng additional payment ang subcontractor para sa excluded interfaces;
- Kulang ang manpower kumpara sa accepted programme;
- Naantala ang testing at successor activities;

Saan Madalas Pumapalya ang Subcontractor Evaluation?
1. Napagkakamalang actual capability ang documentary compliance
Maaaring kumpleto ang forms ng bidder pero kulang naman sa available management, labour, equipment, suppliers o working capital. Mahalagang paghiwalayin ang apat na tests:
- Eligibility: Legal at contractually qualified ba ang contractor para gawin ang package?
- Capability: May sapat ba itong experience at systems para sa ganitong uri ng trabaho?
- Capacity: Available ba ngayon ang kinakailangang resources?
- Commitment: Talaga bang ia-assign at pananatilihin sa project ang ipinangakong resources?
Hindi sapat ang magagandang past projects kung fully committed naman sa ibang contracts ang key people at equipment.
2. Naka-lista ang exclusions pero hindi commercially resolved
Madalas inilalagay lamang sa attachment ang tender qualifications nang hindi sinusuri ang epekto nito sa cost, interfaces at schedule. Ang bawat material qualification ay dapat:
- Tanggapin at lagyan ng malinaw na risk owner;
- I-reject sa pamamagitan ng clarification;
- Ilagay bilang commercial adjustment;
- Isama sa revised tender conditions; o
- I-record bilang residual risk na kailangang aprubahan.
Hindi nawawala ang excluded work dahil lamang hindi ito kasama sa quotation. May ibang party na kailangang gumawa, mag-coordinate o magbayad nito.
3. Tinatanggap ang completion date nang hindi tine-test ang programme
Maaaring mangako ang bidder ng required completion date kahit wala itong malinaw na resource-loaded plan. Dapat suriin ang:
- Mobilization at design-development lead time;
- Material submissions at approval dates;
- Long-lead procurement at fabrication;
- Workfront access at information-release assumptions;
- Productivity at manpower requirements;
- Testing at commissioning sequence;
- Interfaces sa ibang packages; at
- As-built records, manuals at handover requirements.
Ang completion date na walang supporting logic at committed resources ay pangako lamang, hindi execution plan.
4. Masyadong mababaw ang financial assessment
Hindi laging ipinapakita ng financial statements kung kaya bang pondohan ng subcontractor ang particular work package. Mahalaga ring tingnan ang current workload, credit facilities, supplier terms, receivables, retention exposure at dependence sa advance payment.
Posibleng profitable sa records ang isang kumpanya pero kulang sa cash para mapanatili ang payroll at procurement habang hinihintay ang certification at payment.
5. Lahat ng main-contract risks ay ipinapasa nang walang pagsusuri
Hindi sapat ang paggamit ng salitang “back-to-back.” Kailangang tukuyin kung:

Para sa Philippine private construction
Ayon sa Construction Industry Authority of the Philippines, ang CIAP Document 102 ay ang Uniform General Conditions of Contract for Private Construction. Hiwalay ito sa framework para sa government construction.
Gayunman, hindi dapat awtomatikong ipalagay na applicable ang CIAP Document 102 sa bawat private project. Kailangang suriin ang executed contract, incorporation provisions at order of precedence.
Ang Republic Act No. 4566 , na inamyendahan pa ng Republic Act No. 11711 , ang nagbibigay ng Philippine contractor-licensing framework.
Dapat i-verify ang current PCAB licence at ang naaangkop na classification at category para sa work package. Gayunman, ang licence ay eligibility requirement lamang at hindi automatic proof ng available resources o financial capacity.
Para sa Philippine government procurement
Ibang framework ang public procurement. Ang Republic Act No. 12009 o New Government Procurement Act at ang implementing rules nito ang dapat tingnan para sa covered government procurement.

Para sa FIDIC at international projects
Maaaring may provisions ang FIDIC-based main contract tungkol sa subcontractors, nominated subcontractors at Employer o Engineer approvals. May dedicated subcontract forms din ang FIDIC para sa alignment ng relevant obligations.
Ngunit hindi awtomatikong puwedeng kopyahin ang main-contract wording at gamitin bilang subcontract. Depende ang tamang approach sa FIDIC form at edition, Particular Conditions, governing law, design responsibility, approval provisions at final subcontract terms.
Mahalagang qualification: Ang general CIAP o FIDIC guidance ay hindi kapalit ng review ng executed contract, project amendments at applicable law.

Financial resilience
Depende sa proportionality, confidentiality at procurement rules, maaaring suriin ang:
- Audited financial information;
- Working-capital indicators at credit facilities;
- Current receivables at project commitments;
- Supplier arrangements;
- Dependence sa advance payment;
- Forecast cash flow; at
- Kakayahang tiisin ang normal certification at payment timing.
Commercial at contractual position
Dapat may consolidated register ng qualifications, exclusions, assumptions, provisional items, alternative materials, payment terms, retention, securities, insurance, warranties, variations, delay, testing, documentation, suspension, termination at dispute resolution.

Hindi naaayos ng technical compliance ang contractual exclusions, financial weakness, unavailable resources at unrealistic programme.
“Dapat laging lowest bidder ang manalo”
Depende ito sa governing procurement regime at tender conditions. Magkaiba ang private at public procurement requirements.
“Mababawi naman lahat sa back-charges”
